Cubic Waste Terms and Conditions

Term of Rental:

Cubic Waste will provide Customer with a roll-off dumpster in accordance with these terms and conditions. Customer understands that it is their responsibility to contact Cubic Waste when the dumpster is ready for pick up and removal. Daily usage fees shall continue to accrue until Customer has notified Cubic Waste that the dumpster is ready for removal. 

Access:

Customer is responsible for having a clear and accessible path for Cubic Waste to deliver and service the dumpster. If the dumpster is unable to be delivered, inaccessible, or not ready for pick up upon a driver’s arrival, a trip fee of $175.00 will be charged to Customer. Customer understands that daily usage fees will continue to accrue until the dumpster is able to be removed. Customer shall assume the risk and responsibility for all damages of any kind or nature to sidewalks, driveways, buildings, meters, pipes, sprinkler system, trees, shrubbery, lawns, or similar caused by the delivery vehicle or dumpster. 

Use of Dumpsters:

Customer shall not move or relocate any dumpster with their personal equipment and/or a third-party’s equipment. Cubic Waste will move the dumpsters upon request, however a minimum trip fee of $175.00 will be charged to Customer. Customer shall never allow fire to burn in containers or use a trash smashing service. Customer shall not overfill the dumpster or load past the fill line and/or top edge of the dumpster. If the dumpster cannot be removed due to an overload, Customer shall be responsible for unloading all excess debris at their expense and a minimum trip fee of $175.00 will be charged to Customer.

Unacceptable Material:

Customer will accept full and complete responsibility for the contents of the dumpster and agree to additional charges if the dumpster contains unacceptable materials. Dumpsters may only be used for non-hazardous solid waste only. Customer shall not put any liquid, radioactive, volatile, corrosive, highly flammable, explosive, biomedical, infectious, toxic, or any hazardous waste or substances into dumpster.

Prohibited waste includes, but is not limited to, the following:

If the dumpster is discovered to contain any unacceptable materials, Cubic Waste may refuse to remove the dumpster and additional fees will apply.

Weight Limitations:

Customer is responsible for the total weight of their dumpster. Customer shall be charged an additional $50.00 per ton if the dumpster is over the allotted weight limit. The debit and/or credit card on file will be charged for any outstanding balance after the dumpster has been picked up from the subject property and taken and weighed at a surrounding landfill.

Maximum Tonnage Allowances:

Payment:

Prepayment at the time of booking is required by debit and/or credit card. Said debit and/or credit card will be kept on file until the dumpster is removed and Customer’s balance has been paid in full.  Cubic Waste shall have the right to charge Customer’s card on file for initial payment, and as charges accrue after initial payment at any time without notice, which include weight limit and overage fees, and trip fees. Customer understands that in the event customer fails to fulfill their payment obligations, Cubic Waste may refer any such matter to an attorney or collection agency. A mechanic’s lien will be placed on the property once an account goes into collection status. Customer agrees to pay, in addition to any amount due, all costs incurred by Cubic Waste as a result of such actions, including attorney’s fees, court fees, and collection fees.

Liability:

Customer shall be responsible for all damage, destruction, or loss to the dumpster while on a jobsite or in the possession of Customer, and the cost to repair damages and/or replace the dumpster will be charged to Customer. Customer agrees to hold harmless and indemnify Cubic Waste against all claims, lawsuits, and any other liability for injury to persons or damage to property arising out of the possession or use of the dumpster by Customer.

Placement:

Customer understands that placement instructions are taken as “ideal” placement instructions. It is the discretion of the driver completing the job for final placement. 

Miscellaneous:

Cubic Waste reserves the right to modify these terms and conditions from time to time. Customer understands that by placing an order with Cubic Waste, Customer agrees to these terms and conditions. These terms and conditions are severable, so in the event one or more provisions is held by a court of competent jurisdiction to be unenforceable, the remaining provisions shall remain in full force and effect. These terms and conditions shall be governed by and construed in accordance with the laws of the State of Oklahoma. Venue and exclusive jurisdiction for all actions arising out of or relating to Customer’s rental of a dumpster from Cubic Waste or these terms and conditions shall be in the State of Oklahoma District Court in Cleveland County, Oklahoma. The customer hereby consents to the exercise of personal and subject matter jurisdiction by such court with respect to any such proceeding.

I, Customer, acknowledge that I have fully read, agree, and accept the terms and conditions listed in the entirety of this contract.
